Portrait Art Terms Of Service

Before ordering your Portrait Art Work it is important you read the following terms of service, if you have any questions please don't hesitate to email us at creativemindsuk.outlook.com.

Contact
Instructions and details are to be made via telephone or email only. The client must explain in detail all the specific elements of project.We will contact the client back via telephone and email only.

Image Authorization

Once the client has sent us images via email we will analyse project fully. We will then verify whether the pictures can be drawn, and confirm that we understand the specifics laid out.

Price

We do not have a fixed price for the Artwork services we provide, we only do so for the prints sold in our store. Portrait art service prices are subject to change according to the specific project. The client can opt out of the agreement once an estimated quote has been verified. However once agreed to the price, the client is obligated to pay the full amount.

Deposit Payment

Upon accepting our quote, the client is obliged to pay a deposit of 50% of the full price. This payment can be made via PayPal, Major Credit Card Payments and Bank transfers.

Artwork Completion Timescales

Drawing times can vary due to the complexity of the project. An approximate timeline would vary between 7-14 days.

Progress Pictures

With our progression process, we keep the client informed with the progress of the project and an estimated completion date. We are obligated to meet the requirements of the client’s needs and aim to produce artwork as soon possible. A confirmation of completion will be provided.

Final Payment

The client will pay the remainder fee in the exact same medium as the initial payment; PayPal, Major Credit Card Payments and Bank transfers.

Completion and Delivery

Upon Completion, we will deliver the Art work to you personally (depending on location) or via Royal Mail Special Delivery Guaranteed. Art work will be securely wrapped with bubble wrap and cardboard protecting the artwork & frame preventing any delivery damages. Non frame art work will be sent/delivered via a secure postal tube. Delivery times vary from 1 - 5 working days depending on the location of the delivery. We are not liable for any damages or losses in delivery.

Alterations and No Refund Policy

We take on a strict no refund policy. As the order is placed the client is given the opportunity to observe and validate the progress of the project. Any alterations should be made at this stage before the project is finalized. Substantial changes might incur additional charges.

Delayed Payment

After the project has commenced and the final payment is due, the client will have 14 days to complete the payment. During this period the client will have 5 days to pay the final fixed cost fee. If this is not paid the remaining 9 days will be result in a daily 10% increase on the total fixed cost price, which will be added each recurring day.

Indemnity 
The client agrees to indemnify and hold harmless CreativemindsUK from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys’ fees and costs, but only to the extent caused by, arising out of, the work supplied by CreativemindsUK.

Confidentiality
The client should inform us, in writing before the project commences if any portion of any material or information provided by the client or if any portion of the project is confidential.

Copyright

CreativemindsUK retains copyright on all the artwork. By placing an order for our services you are agreeing that CreativemindsUK retain the full rights to the artwork produced. CreativemindsUK may use the artwork in any way seen fit for an indefinite period of time. This includes displaying the artwork for promotional purposes.

 

Commissioned artwork is normally displayed on this site in the portfolio or blog tabs. We also display the artwork on social media sites when completed. The artwork may also be submitted on the online gallery: aaron1samuel.wix.com/ads-illustration. The commissioned artwork will not be sold to third parties. We do not create copies to sell on as merchandise or as prints. Pencil portraits are sold for personal use only and not for the client's financial gain. Under no circumstances should portraits be made available for download or sale. CreativemindsUK reserves the right to take legal action against any individual or business failing to adhere to the above Copyright Terms and Conditions.


Graphic Design & Printing Terms Of Service

Samples

The client must provide CreativemindsUK with samples of print design that result from the project deliverable. Such samples must be representative of the highest quality of work. CreativemindsUK is allowed to use copies and samples for promotional purposes. CreativemindsUK reserves the right to photograph all completed designs or installations for publication or other promotional purposes.

Project Planning and Design Clarification

Project ideas and creative thoughts will be communicated with the client via email and telephone. The client is expected to work closely with the CreativemindsUK team to reach the best objective possible.

Price

We will commence the project once the deposit has been received. The timescale can vary due to the complexity of the project but as an approximate we work between 1 - 7 days.

If the size of the file is too big for an email we will provide a downloadable link for the client to download the file independently. We are not liable for any damages or losses in delivery.

Ownership rights
The client is entitled to full ownership of all final graphics or prints created during the project upon full payment of the agreed fee. All services provided by CreativemindsUK must be for the exclusive use of the client other than for promotional use on our site. Upon payment of all fees, the following exclusive reproduction rights for all approved final designs created by CreativemindsUK for this project will be granted to the Client. The Client gains full transferable rights to brand identity and full license to reproduce works through commercial printers.

Third party Participants 
CreativemindsUK may provide services with other creative professionals to provide services such as web development, photography, and illustration. Any third party terms and conditions will include full reproduction rights for the client. Where such participation adds to the project cost, the client will be asked for permission to proceed.

Confidentiality
The client should inform us, in writing before the project commences if any portion of any material or information provided by the client or if any portion of the project is confidential. If during project commencement the client communication (face-to-face, telephone, or email) stops for a lengthy period of more than 10 days, we will see it as a breach of agreement and will result in a cancelation. If communication ceases after the deposit has been paid we are entitled to keep the deposit.

 

Video Production Terms Of Service
 

Whilst placing an order for any video production service from filming to editing it is important you read the following terms of service. If you have any questions please don't hesitate to email us at creativemindsuk.outlook.com.

Footage Copyright

The footage that has been captured by CreativemindsUK is solely owned by us and protected under copyright Law. Upon completion and cleared funds, we will, in some instances and upon prior agreement, transfer the Copyright Ownership to the Client. This will be clearly specified via email or telephone. In both circumstances, CreativemindsUK reserves the right to use the footage for promotional purposes. In the event of the Client providing footage (video, audio, photographs, logos etc) for inclusion into a CreativemindsUK production, copyright must firstly be obtained from the original copyright owner. The material provided to CreativemindsUK should be able to be used freely and the client will have to indemnify CreativemindsUK against any future possible claims, disputes, expenses or similar that may arise for a third party concerning usage of such material. Cretaivemindsuk will reserve the right to use the final production in full or part content for promotional purposes.

Price

Progress Footage
During the project updates will be sent to the client via email. Two drafts will be sent to the client, one will be sent half way through the project and a second draft will be sent for a final review. A confirmation of completion time will also be confirmed once the second draft has been sent and approved by the client. We will then proceed with the final payment.

No Refund Policy

We take on a strict no refund policy. As the order is placed the client is given the opportunity to observe and validate the progress of the project. Any alterations should be made at this stage before the project is finalized. Substantial changes might incur additional charges.Once the project has been completed and sent by us to the client we are not liable for any loss or damage.

Health and Safety

In all instances CreativemindsUK reserve the right to remove any of its personnel and / or equipment from a location if it is deemed unsafe or if they are subjected to abusive or aggressive behavior. In this instance the Client will be liable for any costs incurred.

Unexpected Circumnstances

In the event of inclement weather or other unforeseen circumstances CreativemindsUK reserves the right to change the filming date to a more suitable one.In the event of filming being delayed/ aborted due to a lack of organisation from the Client, CreativemindsUK reserves the right to charge the relevant amount. A re-visit to the site to carry out further footage may incur additional cost.

 

Changing filming dates

If the client wishes to change the filming date we insist on a minimum of one weeks notice. Failure to comply will result in the Client becoming liable for all additional charge with no exceptions.

 

Equipment substitution / failure

In the unlikely event that CreativemindsUK experiences equipment failure or difficulties, all efforts will be made to find suitable replacements. If for any reason we are unable to provide the service promised then the client is entitled to a refund of the initial deposit, that 50% of full price.

 

Clear access for environment
If filming venues are being organised by the Client, it is the Clients responsibility to ensure that CreativemindsUK has full access to all relevant locations.
